1. Who we are & acceptance of these terms
ApeXhit LLC ("ApeXhit," "we," "us," or "our") is a Florida limited liability company (Articles of Organization filed and effective June 26, 2026). We develop and operate ApeXhit DBC (the "App"), a digital business card and QR/NFC contact-sharing tool available at https://apexhit-dbc.vercel.app.
These Terms of Service ("Terms") govern your access to and use of the App, including its installable Progressive Web App (PWA) version. By visiting, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
We may update these Terms from time to time as described in Section 12. Continued use of the App after an update constitutes acceptance of the revised Terms.
2. What the App does
The App lets you:
- Create and store multiple digital business cards (name, title, company, contact details, social links, logo, and profile photo) and switch between them by swiping.
- Display a QR code on the front of each card that encodes your contact information for scanning by others, sized for reliable scanning.
- Read/scan QR codes using your device camera through a built-in scanner.
- Push your currently selected card's contact information (vCard) to another NFC-capable device using your device's NFC radio and the Web NFC API (supported browsers/devices only). The App only writes/transmits data over NFC — it does not read or receive data from other devices via NFC.
- Generate print-ready card layouts sized to standard credit-card dimensions, with cut margins, for professional printing.
- Customize card appearance with built-in themes, custom uploaded background images, and custom QR code colors/icons.
- Export and import your card data as a backup file, and export/import individual or combined contacts as vCard (.vcf) files.
- Browse other live ApeXhit apps and featured businesses through the in-app "waffle" directory, which is loaded from apexhit.org.
- Install the App to your device's home screen as a Progressive Web App for faster, offline-capable access.
3. Where your data lives
The App is designed to store your card data locally on your own device (in your browser's local storage), not on our servers. We do not operate a backend database of your cards, contacts, photos, or logos. See our Privacy Policy for full details, including the limited exception for the waffle directory network request.
Because your data lives on your device, YOU are responsible for backing it up (via the in-app Export Backup feature) before clearing browser data, switching devices, or uninstalling the App. We cannot recover data that was never backed up.
4. Eligibility and acceptable use
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement, or that you are doing so with the involvement of a parent or guardian.
You agree not to:
- Use the App for any unlawful purpose, or to create or share cards containing content that is fraudulent, impersonates another person or business without authorization, or infringes a third party's rights.
- Attempt to gain unauthorized access to the App's source code, hosting infrastructure, or any connected system, including through scraping or automated bulk requests.
- Reverse engineer, decompile, or extract source code from the App or its installable PWA except to the extent such restriction is prohibited by applicable law.
- Use the QR/NFC sharing features to transmit malware, phishing links, or content designed to harm the recipient's device or deceive the recipient.
- Copy, reproduce, or misrepresent our branding, logos, icons, or built-in card templates as your own for resale.
5. Your content
You retain all ownership rights in the contact information, photos, logos, background images, and slogans you enter into the App ("Your Content"). Because Your Content is stored locally on your device, you are solely responsible for its accuracy and for ensuring you have the right to use any photo, logo, or image you upload. We do not review, endorse, or moderate Your Content, as we generally do not have access to it.
You are solely responsible for the accuracy of any contact information you share via QR code, NFC push, vCard export, or the share-link/share-image feature, and for how recipients may use that information.
6. Intellectual property
The App itself — including its design, card templates, built-in themes, icon sets, source code, and the ApeXhit name and logo — is owned by ApeXhit LLC or licensed to us and is protected by U.S. and international intellectual property laws. Subject to your compliance with these Terms and our End User License Agreement, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App for your own personal or business card-sharing purposes.
7. NFC and QR functionality — device & browser limitations
NFC push functionality depends on your device having NFC hardware and using a browser that supports the Web NFC API (currently limited to certain Android/Chrome combinations); it is not available on all devices or browsers, including most iOS browsers. QR scanning requires camera access, which you must grant through your browser/OS permission prompt. We are not responsible for hardware, OS, or browser limitations outside our control that prevent these features from working on your specific device.
8. Third-party links & the waffle directory
The in-app waffle directory loads a list of other live ApeXhit apps and featured businesses from apexhit.org and links out to them. We are not responsible for the content, availability, or practices of those linked apps and sites beyond the accuracy of the directory listing itself; each linked ApeXhit app has its own Terms and Privacy Policy.
9. Current pricing & future paid tiers
The App is currently free to use. We may introduce optional paid tiers or features in the future (for example, additional templates, cloud sync, or printing services). If we do, additional terms specific to that paid tier — including pricing and billing — will be presented to you before you are charged, and our Refund Policy will govern refund requests for any such purchase.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that QR codes will scan correctly on every device or printer, that NFC push will work on every device, that printed card dimensions will match every printer's calibration exactly, or that the App will be uninterrupted, secure, or error-free. Because your data is stored locally, we do not warrant against data loss due to device failure, browser data clearing, or uninstalling the App — please use the backup feature regularly.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXHIT LLC AND ITS MEMBERS, OFFICERS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING LOSS OF LOCALLY STORED CARD DATA. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US, IF ANY, FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Changes to these Terms
We may revise these Terms from time to time. The "Effective date" at the top of the Legal Center reflects the most recent revision. Material changes will be reflected by updating that date; your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
13. Governing law & dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved informally by contacting us at apexhit00@gmail.com. If a dispute cannot be resolved informally within thirty (30) days, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, and you consent to personal jurisdiction and venue there.
